Please read these Terms and Conditions carefully before using the TMS Book mobile application and services. By accessing or using our app, you agree to be bound by these Terms and Conditions.

1. Acceptance of Terms

By downloading, installing, or using the TMS Book app, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our app.

2. Description of Service

TMS Book is a transport management system mobile application that helps users manage their transport business operations, including trip management, financial tracking, vehicle management, and reporting.

3. User Account

3.1 Account Registration

To use certain features of our app, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Subscription and Payment

4.1 Free Trial

We offer a free 1-year subscription for the first 5,000 users. After the free period, subscription fees apply as per our pricing plans.

4.2 Subscription Fees

After the free trial period, the subscription fee is ₹1,999 per year. Enterprise plans have custom pricing based on requirements.

4.3 Payment Terms

• All fees are payable in advance
• Payments are processed through secure third-party payment processors
• Subscription automatically renews unless cancelled
• Refunds are subject to our refund policy

4.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds will be provided for the remaining period.

5. User Responsibilities

You agree to:

• Use the app only for lawful purposes and in accordance with these Terms
• Not use the app to violate any laws or regulations
• Not attempt to gain unauthorized access to the app or its systems
• Not interfere with or disrupt the app's functionality
• Not use the app to transmit any harmful code or malware
• Maintain accurate and complete business records

6. Intellectual Property

The TMS Book app, including its design, features, functionality, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the app or its content
• Reverse engineer or attempt to extract source code
• Remove any copyright or proprietary notices
• Use our trademarks or logos without permission

7. Data and Content

7.1 Your Data

You retain ownership of all data you input into the app. You grant us a license to use, store, and process your data to provide our services.

7.2 Data Backup

While we implement backup systems, you are responsible for maintaining your own backups of important data. We are not liable for any data loss.

8. Service Availability

We strive to provide continuous service availability but do not guarantee uninterrupted or error-free operation. We may:

• Perform scheduled maintenance that may temporarily interrupt service
• Modify or discontinue features with reasonable notice
• Suspend or terminate accounts that violate these Terms

9. Limitation of Liability

To the maximum extent permitted by law:

• We provide the app "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the past 12 months
• We are not responsible for business decisions made based on app data

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the app, violation of these Terms, or infringement of any rights of another party.

11. Termination

We may terminate or suspend your account and access to the app immediately, without prior notice, for any breach of these Terms. Upon termination:

• Your right to use the app will cease immediately
• We may delete your account and data
• You remain liable for all charges incurred up to the termination date

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the app after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
